Terms of Service

These terms govern the relationship between Digidodo and the businesses that use the Digidodo Menu digital menu service. By purchasing a plan, accepting our offer or signing in to the panel, you accept these terms.

This is an English translation provided for convenience. If there is any difference between the English and Turkish versions, the Turkish version prevails.

1. Parties and definitions

The service is provided by Digidodo Prodüksiyon ve Reklam Hizmetleri Anonim Şirketi (“Digidodo”). The restaurant, cafe, beauty centre or similar business purchasing the service is referred to as the “Business”.

  • Service: the Digidodo Menu software (customer menu and business panel) and the setup, translation, content update and photo shoot services included in the chosen plan.
  • Plan: Digital, Professional, Premium or a tailored offer; its scope is what is stated on our website or in the offer at the time of purchase.
  • Content: the names of items and services in the menu, prices, descriptions, ingredients, allergen and calorie information, photos, logo and other business information.

The service is offered only to businesses for commercial purposes; it is not a consumer transaction.

2. Formation of the contract

The contract is formed when the Business accepts the plan offer in writing (including by email or WhatsApp) and makes the payment. The plan term and scope are shown on the invoice and in the business panel.

3. Scope of the service

  • Your menu is published online through a dedicated link and QR code. The QR code does not change during the plan term or as long as the plan is renewed.
  • You can update your items, prices, categories, campaigns and business information yourself in the business panel.
  • On the Professional and Premium plans our team does the initial setup; on Premium the initial setup covers up to 150 items or services, and anything beyond that is quoted separately. Content updates, translations and photo shoots included in a plan are limited to the number and scope stated in the plan; unused entitlements do not carry over to the next term.
  • One content update is a list of changes the Business sends in one go (prices, adding and removing items, descriptions and photos); rebuilding the whole menu is not covered.
  • On the Professional and Premium plans the branded QR card design is delivered as a print-ready file; printing and stands are not included and are offered on a separate quote.
  • The date and location of a photo shoot are planned together. If a shoot cannot take place for reasons attributable to the Business, a reasonable new date is set.
  • Reels, video and social media management are not included in this service; they are offered under a separate quote.
  • The service is not an ordering, payment or booking system, and no commission is taken on your sales.

4. Fees and payment

  • Plan fees are yearly and paid in advance. Prices on the website exclude VAT.
  • Second and further branches get a discount of 25% to 50%, depending on the number of branches.
  • Additional services (extra language, extra shoot, setup for the Digital plan, etc.) are charged separately.
  • Price changes do not affect an ongoing plan term; the current price applies at renewal.
  • Renewal, cancellation and refund terms are set out on the Renewal, Cancellation and Refunds page and form part of these terms.

5. Obligations of the Business

  • Accuracy of content: the Business is responsible for all prices, ingredients, allergens, calories and other information in the menu being accurate and current. When our team enters the information, it is based on information provided by the Business and is checked and approved by the Business.
  • Compliance: obligations specific to your sector, such as price labelling, food labelling and informing consumers, belong to the Business. The tools in the service make these obligations easier to meet; they do not guarantee compliance on their own.
  • Helper tools: results from the calorie calculator, allergen suggestions, translation and similar tools are approximate or suggestions; they should be checked before use.
  • Rights: the Business confirms that it has the right to use the photos, logo and texts it uploads and that they do not infringe third-party rights.
  • Account security: keeping panel passwords secret, keeping authorised users up to date and removing access for people who leave is the Business’s responsibility.
  • The service may not be used for unlawful or misleading content or content that infringes third-party rights.

6. Obligations of Digidodo

  • We make reasonable efforts to provide the service with care and without interruption. Brief interruptions may occur due to planned maintenance, failures of infrastructure providers and force majeure.
  • We process your data in line with the Law and the Privacy Notice (KVKK), and take reasonable technical and administrative measures against unauthorised access.
  • You can export your item, category and price data to Excel from the panel at any time.
  • We may add or change features to improve the service; we will not narrow the core scope of the plan you purchased to your detriment during the term.

7. Intellectual property

  • The Digidodo Menu software, design and brand belong to Digidodo; the Service grants a right of use for the plan term.
  • The Business’s content belongs to the Business. Digidodo uses this content only to provide the Service.
  • The Business may use photos taken by Digidodo under the plan in its own menu, social media and promotion without time limit. Unless the Business objects in writing, Digidodo may show these photos among its own work samples.

8. Limitation of liability

Digidodo is not responsible for errors in content entered or approved by the Business or for their consequences. Except in cases of intent and gross negligence, Digidodo’s total liability arising from this contract is limited to the plan fee paid by the Business in the 12 months before the damage occurred; no liability is accepted for loss of profit or indirect damages.

9. Suspension and termination

  • In cases of non-payment, unlawful use or situations that endanger the security of the Service, we may suspend the Service with prior notice (without notice in urgent security situations).
  • If either party breaches a material obligation and does not remedy it within 15 days of written notice, the other party may terminate the contract.
  • After the contract ends, the menu is taken offline and data is stored as described in the Renewal, Cancellation and Refunds terms.

10. Changes to these terms

We may update these terms. We will notify you of significant changes by email or WhatsApp at least 30 days before they take effect. Changes do not alter the fee or plan scope to your detriment during an ongoing plan term.

11. Notices, governing law and jurisdiction

The parties accept that correspondence through the email addresses stated in the contract or invoice and through WhatsApp constitutes valid notice. These terms are governed by Turkish law; the Istanbul Anatolian Courts and Enforcement Offices have jurisdiction over any disputes.
